These Terms & Conditions (“Terms”) govern your access to and use of https://desertcloud.tech and any services provided by Desert Tech Developer and Cloud Services FZ-LLC (“Desert Tech”, “we”, “us”, “our”). By using our website or services, you agree to these Terms. If you do not agree, do not use our services.
1. Who We Are
Desert Tech is registered in the United Arab Emirates (DIFC/RAKEZ). These Terms are governed by UAE law and, where applicable, comply with EU consumer and e-commerce regulations for users in the European Union, and general international commercial standards for users elsewhere.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering binding contracts to use our services.
3. Services
Desert Tech provides web hosting, cloud infrastructure, blockchain/fintech, and related digital products, including services under the ReSystem and INFRA Network ecosystem. Features, pricing, and availability may change or be discontinued at our discretion, with reasonable notice where practicable.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
5. Acceptable Use
You agree not to:
- Use our services for unlawful, fraudulent, or harmful purposes.
- Infringe intellectual property, privacy, or other rights of third parties.
- Distribute malware, conduct unauthorized access, or disrupt our infrastructure.
- Use our services to violate anti-money-laundering, sanctions, or KYC regulations.
- Reverse-engineer, resell, or misuse our platforms without authorization.
6. Fees & Payment
Fees for paid services are as stated at the time of purchase. Unless otherwise specified, fees are non-refundable. We may suspend or terminate services for non-payment. Prices may be in AED, reAED, or other stated currency, and are subject to change with prior notice for future billing cycles.
7. Blockchain & Digital Assets
Where services involve blockchain-based products (e.g. INFRA Network, reAED, tokenized assets), you acknowledge that digital assets carry inherent risks including volatility, regulatory change, and irreversibility of on-chain transactions. Desert Tech is not a financial advisor, and nothing in our services constitutes investment advice. You are responsible for complying with applicable laws, including UAE VARA regulations, in your use of such services.
8. Intellectual Property
All content, trademarks, logos, and software on our platforms are owned by or licensed to Desert Tech and protected under applicable intellectual property laws. You may not copy, modify, or distribute our content without prior written consent.
9. Third-Party Links & Content
Our services may link to or embed third-party content. We do not control and are not responsible for third-party sites, their content, or their privacy practices.
10. Disclaimers
Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement, to the maximum extent permitted by law.
11. Limitation of Liability
To the extent permitted by applicable law, Desert Tech shall not be liable for indirect, incidental, special, or consequential damages, or loss of data, profits, or digital assets, arising from your use of our services.
12. Indemnification
You agree to indemnify and hold Desert Tech harmless from claims, losses, or damages arising from your breach of these Terms or misuse of our services.
13. Data Protection
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data in compliance with UAE PDPL (Federal Decree-Law No. 45 of 2021), EU GDPR, and other applicable data protection laws.
14. Termination
We may suspend or terminate your access to our services at any time for breach of these Terms, unlawful use, or as required by law or regulation. You may stop using our services at any time.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates (including applicable DIFC/RAKEZ free zone regulations). Disputes shall first be addressed through good-faith negotiation, failing which they shall be subject to the exclusive jurisdiction of the competent UAE courts or arbitration, as applicable. For EU users, mandatory local consumer protection rights are not affected by this clause.
16. Changes to These Terms
We may update these Terms periodically. Continued use of our services after changes take effect constitutes acceptance of the updated Terms. Material changes will be reflected by updating the “Last updated” date above.
